SECTION II - REVISIONS TO THE PERMIT The following is a summary of revisions to the permit since the PR6 proposed decision dated January 6, 2012. Since the PR6 decision was issued, there has been a decrease in bond amount required from $6,743,430.00 to the current liability amount of $6,255,552.61. As stated in Section VI, the current bond amount held is more than the required liability amount calculated by the Division ($5,818,456.00). Approve, No 2/25/2013 TR77 Demonstrations for Permanent Retention of Sedimentation Ponds and Approve, No Stockponds. 4/8/2013 SECTION III - STATUS OF STIPULATIONS Two stipulations are attached to this permit. Stipulation 32 was attached to the TR -42 proposed decision issued October 14, 2003. Stipulation 39 was attached to the TR77 proposed decision issued on April 30. 2013. Stipulation 32: "For permanent road retention on reclaimed lands, the permittee will submit, within a complete revision application, demonstrations of compliance with 4.03.1(1)(f) or 4.03.2(1)(g) as applicable. The demonstration will include copies of signed landowner requests for road retention from each affected landowner. All road or segments of roads requested for retention will be identified consistent with designation in the permit application (Haul Road G, Ridgeline Access Road, Oil Well Access Road, Etc.). The Road retention demonstrations will be submitted to and approved by the Division prior to approval of Phase 1 Bond Release for any Reclamation Parcel that includes a road or road segment to be retained for the post mining land use." This stipulation has been complied with. Attachment 20 -2 contains justification for the retention of the permanent roads and Appendix 20 -2.1 contains Surface Owner Requests to retain Permanent Features and Structures which include the permanent roads.
