There <br />are several deficiencies in the response that will need to be addressed prior to the Division's approval of TR10. <br />Adequacy Review No. I Response Review: <br />Tab 03; Adiudication file <br />1. Your response to item #3 of the Division's first adequacy review letter indicates that included with your <br />adequacy review response letter was your most up to date copy of page 3 -1.1 of Appendix 3 -1. However, <br />only the "Permit Area Legal Description Summary" sheet was included with the revised pages and your <br />copy of page 3 -1.1 was not included. Please submit your revised copy of page 3 -1.1 of Appendix 3 -1. <br />2. The response to item #4 of the Division's first adequacy review letter does not address the permit <br />deficiency the Division noted in that item. Rule 2.03.6 states, "Each application shall contain a complete <br />and detailed legal description of the proposed permit boundary ". Appendix 3 -1 contains a detailed legal <br />description of the original Hayden Gulch Loadout permit boundary but does not include a detailed legal <br />description of the Tie - Across Haul Road. Please submit a copy of the detailed legal description for the <br />Tie - Across Haul Road to be included in Appendix 3 -1 in order to comply with Rule 2.03.6. <br />Tab 20; Reve2etation Plan <br />In regards to the areas to be revegetated to cropland within the Tie - Across Haul Road corridor, the <br />response to item 46 of the Division's first adequacy review letter does not address the permit deficiency <br />the Division noted in that item. Rule 2.05.4(2)(e), includes the requirements necessary for a revegetation <br />plan that must be included within a permit. Tab 20 does not include a plan for revegetation for Cropland. <br />Rule 4.15.1(2)(c) indicates if the approved post mining land use is cropland, planting of the crops <br />normally grown in the area will meet the requirements for establishing an effective and permanent <br />vegetation cover on the disturbed land.
