21.5 When determining the net amount of water available for augmentation use under <br />this plan, water released from Riverside Reservoir and /or Jackson Lake for augmentation <br />purposes under this decree, or other augmentation water added to this plan in the future, shall be <br />assessed transit losses by the Division Engineer between the points of release and the South <br />Platte River adjacent to the Barlow Pit in the same percentage, per mile, as the Division Engineer <br />may assess against other augmentation water delivered through similar reaches. <br />22. Proiection Updates. Applicant will update the annual projection if and when any of the <br />projections set forth in the annual projection become inaccurate based on actual operations. <br />Applicant shall submit all updates to the Division Engineer and Water Commissioner, with all <br />back -up information to support the revised projections. The updates and back -up information <br />will also be provided to Objectors upon request and payment of reasonable copying and delivery <br />costs. <br />23. Projection Spreadsheet/Water Balance. The annual and any updated projections for <br />Applicant's plan for augmentation shall be submitted on the projection spreadsheet attached <br />hereto as Exhibit D. The projection spreadsheet is not approved by this decree and may be <br />changed from time to time so long as all information required is included in the spreadsheet, all <br />changes are approved by the Division Engineer, and notice of such changes is provided to all <br />Objectors. The projection spreadsheet submitted for any given accounting year, and any updates, <br />shall demonstrate that the projected depletions associated with the water uses augmented by this <br />plan for augmentation will not exceed the augmentation credits available under this plan, in any <br />given month. In order at depletions from the Barlow Pit and the Batch Plant Commercial Well <br />and Irrigation Well and return flow obligations can be fully replaced in time, location, and <br />amount under the terms and conditions of this decree by the amount of projected augmentation <br />supplies, Applicant's well pumping shall at all times be limited to the amounts allowed by the <br />projections completed in accordance with Sections 20 through 22 of this Decree. If at any time <br />the projected depletions from well pumping and return flow obligations that must be replaced <br />under this plan for augmentation exceed projected supplies, Applicant shall immediately do one <br />of the following (or some combination thereof): <br />23.1 Additional Water Rights. Applicant may secure by purchase or lease <br />sufficient water rights in accordance with Section 18 of this Decree, which will be <br />sufficient in time, location and amount to replace all projected depletions and return flow <br />obligations under this Decree. <br />23.2 Reduction of Pumping. Applicant may reduce the out of priority <br />depletions from the Batch Plant Commercial Well and /or Irrigation by curtailing well <br />pumping in an amount which will assure that all well depletions and return flow <br />obligations projected under Sections 20 through 22 of this Decree will be replaced in <br />time, location, and amount in accordance with the terms and conditions of this Decree. <br />23.3 Backfill of Barlow Pit. Applicant may reduce the amount of the surface <br />area of water within the Barlow Pit by back - filling a portion of the same so as to reduce <br />the amount of evaporative loss from the Barlow Pit. <br />13 of 17 <br />
