Abel Montoya
DIRFC'IOR
June 19, 2013
Tony Waldron, North Unit Leader
Department of Natural Resources
Division of Reclamation, Mining & Safety
1313 Sherman St., Room 215
Denver, CO 80203
Re: Debetz Pit Permit M -1977 -283
DRMS Civil Penalties Due Letter Dated July 11, 2013
Dear Mr. Waldren:
Planning & Development Department
4430 South Adams County Parkway
1° Floor, Suite W2000A
Brighton, CO 80601 -8216
PHONE 720.523.6800
FAX 720.523.6998
www.adcogov.org
While it is this Department intention to maintain compliance with DRMS regulations, a situation
of compounding errors delayed our payment of the required 2012 annual fee for the Debetz Pit.
The pit was mined by the County's Public Works Department and has been mined out and in
reclamation since 2001. The pit is on property under the County's Parks Department control and
is located at the north end of the County's golf course which uses it as a water hazard.
Adams County made a major business office move to a campus in 2011. Mail received at our
campus has not always found its way to the proper end point. We believe the original notice for
the annual fee sent in November of 2012, was lost in the system.. We did receive the "Final
Notice" mailed in January of 2013, with a deadline of February 1, 2013.
We immediately sent the notice to our Parks Department for a 112c Annual Report, as the pit is
under Parks Department's jurisdiction. We received the report back from Parks on January 28a'
and sent a request for a check taken out of my budget on January 29a'. The check was dated
March 5a'.
We realize this is not an excuse and have taken steps to prevent an occurrence like this from
happening again. Since the pit will continue to be handled by multiple County Departments, we
will send a request for an Annual Report to our Parks Department in December regardless of
receipt of notification from DRMS.
Due to these circumstances we are asking for the civil penalties to be waived this one time.
Thank you for your time and consideration. Any questions regarding this request may be
directed to Craig Tessmer at 720 -523 -6841.
cerely, .
c eon
Craig T er
Environmental Analyst
B O A R D OF C O U N T Y C O M M I S S I O N F R S
Eva J.
