Executive Director <br />3609 North County Road 13 Loretta Pineda <br />Loveland, CO 80538 Director <br />Re: Coulson Excavating Company, Inc., Challenger Pit, Permit Number M- 1985 -026 <br />Second Follow -up on Unresolved Problems from September 26, 2012 inspection report <br />Mr. Coulson: <br />The Challenger Pit has problems noted below which according to Division of Reclamation, Mining and Safety <br />(Division) records have not been resolved. The following problems were to be resolved on or before March 31, <br />2013. The description and corrective action for the problems are listed below. Please resolve the corrective <br />actions and provide evidence of such resolution on or before August 19, 2013. <br />Please note if the corrective actions are not properly addressed and evidence provided to the Division by the <br />date provided above, the listed problems could be escalated to the level of possible violations and would be <br />referred to the Mined Land Reclamation Board for further action. <br />PROBLEM /POSSIBLE VIOLATION: <br />The Division has no evidence the Operator has a valid well permit, substitute water supply plan, or <br />approved water augmentation plan for the exposed groundwater at the site. This is a problem related <br />to 34- 32.5- 116(4)(h) of the Colorado Revised Statutes and 3.1.6(1)(a) of the Construction Materials <br />Rules and Regulations governing injury to existing water rights. <br />CORRECTIVE ACTIONS: <br />The Operator shall demonstrate the operation is in compliance with the Office of the State <br />Engineer or show evidence the Operator is taking measures to bring the site into compliance <br />with the SEO. <br />PROBLEM /POSSIBLE VIOLATION: <br />The lake slopes are steeper than the required 3H:1V slopes from 5 feet above to 10 feet below the <br />expected water line as required by Rule 3.1.5(7) and as per the approved Reclamation Plan for the site <br />for sections of Pond 1 and 3. <br />CORRECTIVE ACTIONS: <br />The Operator must demonstrate the slopes are in compliance with the approved reclamation <br />plan or re -grade the out of compliance lake shoreline slopes to the required horizontal to <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
