k4p ✓ K Of)
Date: June 13, 2013
/To: Colorado Division of Reclamation, Mining and Safety
1313 Sherman St, Room 215
RECEIVED
Denver, CO 80203
FromKMN Properties
iN 17 ?013
Lavena E. Saunders
DIVISION OF RECLAMATION
22195 Road P
MINING AND SAFETY
Cortez, CO 81321
This letter is in regard to Hay Camp Pit, Permit No. 4-'1990 -025.
We have been notified McStone Aggregates has submitted a request for a partial acreage release
for the Haycamp Pit.
We o- bie t to a small portion, (two areas) within the parcels requested for release due to
reclamation activities not being complete or unable reclaim at this time.
One of the areas referenced is the current weigh scale location and surrounding area. The scale
will be moved in the coming months. Construction activities, fill placement etc. will prevent any
reclamation from being accomplished until the scale is removed.
The second area of concern is just West of the scale area. It is a low place between two roads with
piles of fill dirt adjacent. So this area cannot be designated final grade.
I have included a copy of the map provided by McStone Aggregates. I have highlighted the
approximate location of these two areas in pink. I have also included pictures. It will be the
responsibility of McStone Aggregates for any necessary delineation or acreage calculation.
We wish that all existing gravel roads remain in place.
We have a concern unrelated to reclamation activities. Recent events lead us to believe McStone
Aggregates is applying for a new and separate permit with the Colorado Division of Reclamation,
Mining and Safety as well as the Montezuma County Board of County Commissioners. The map
provided by McStone Aggregates shows an area labeled Zone B and designates this area to be
"Possibly to be added to Permit ". The map also shows a road intersecting the two properties. This
is an access road along the existing power line. No legal access exists between the two properties. I
have highlighted this area in yellow on the enclosed map.
4aLv e n a E. Saunders
Harry ogers
e&- /, , 0 & L 4 1 )
Michelle D. Welsh (POA Lavena Saunder
