<br />Thanks for the quick response. With regard to the Certificate of Liability Insurance the Division has the following
<br />concerns with the information presented and compliance with Rule 2.03.9:
<br />The Certificate of Liability Insurance number 18784785 for Policy Number HDOG2701351A states that the policy
<br />covers ALL Peabody Energy Corporation and Subsidiaries operations in Routt and Moffat Counties, Colorado,
<br />and Carbon County, Wyoming, including damage from surface coal mine operations, the use of explosives, and
<br />damage to water wells. The Division recognizes ALL Peabody Energy Corporation and Subsidiaries operations
<br />in Routt and Moffat Counties, Colorado as: the Foidel Creek Mine, C- 1982 -056 (Twentymile Coal, LLC); the
<br />Peabody Sage Creek Mine, C- 2009 -087 (Peabody Sage Creek Mining, LLC); the Seneca II Mine, C- 1980 -005
<br />(Seneca Coal Company, LLC); the Seneca II -W Mine, C- 1982 -057 (Seneca Coal Company, LLC); the Yoast
<br />Mine, C- 1994 -082 (Seneca Coal Company, LLC ); the Hayden Gulch Loadout, C- 1992 -081 (Hayden Gulch
<br />Terminal, LLC); and the Williams Fork Mines, C -1981 -044 (Moffat County Mining, LLC).
<br />In addition, the Certificate of Liability Insurance identifies Twentymile Coal, LLC, Colorado Yampa Coal Company,
<br />Shoshone Coal Corporation, BTU Empire Corporation and Moffat County Mining, LLC. The list does not include
<br />Peabody Sage Creek Mining, LLC, Seneca Coal Company, LLC, or Hayden Gulch Terminal, LLC.
<br />In order for the Division to ensure compliance with Rule 2.03.9, please address if the Limits identified for policy
<br />number HDOG2701351A are associated with only the Foidel Creek Mine, C- 1982 -056, or if the limits identified
<br />represent the total coverage limits for all sites under policy number HDOG2701351A combined. If the policy
<br />number and limits represent the minimum amount for all sites combined, please identify the name of the site,
<br />name of the operator, and the permit number on the certificate of liability insurance in which the policy covers.
<br />the minimum limits identified represent only the minimum limits for the Foidel Creek Mine, please identify only
<br />the site (Foidel Creek Mine), operator (Twentymile Coal, LLC), and permit number (C- 1982 -056).
