In addition the <br />revision also proposes to allow Metro Wastewater Reclamation District temporary and permanent easements <br />for Metro's benefit to accommodate its construction and operation of a new wastewater treatment plant and <br />associated pipelines (the "Northern Treatment Plant "). It also grants Metro related to its sanitary sewer pipeline <br />and associated facilities, rights for riparian and wetland mitigation associated with construction of the Northern <br />Treatment Plant. The plan also requires a change in the approved seed mix which is included in the technical <br />revision. The Division has the following questions to be addressed prior to approving the revision. <br />1) The post mining land use under Amendment #2 and approved on October 3, 2002 is for the site to be <br />developed as recreation areas, with developed water resources of wetlands and lakes. How does a <br />waste water treatment facility and sanitary sewer pipe line meet this post mining land use, if the <br />construction is prior to release of site from reclamation responsibilities? Please explain <br />2) Where is the detailed design for the Metro waste water pipe lines? Where will the road be located for <br />the Metro Access? Would it be permanent or temporary? The Division requires a detailed map showing <br />the location of each structure labeling which ones will be permanent and which ones will be temporary <br />under the easement agreement. Would additional warranty be required to remove the associated <br />structures, and reclaim areas affected under the temporary easement? If any that will remain in place <br />must be shown in the revised plan maps. Such structures include access road, pipelines etc. Please <br />explain. <br />3) Where is the additional material going to come from to back fill the lake area? Would a notice in <br />accordance with Rule 3.1.5(9) be necessary to import inert fill from outside sources? Please explain <br />4) Even though Metro is going to undertake the reclamation of the mitigation areas, the ultimate <br />responsibility for the site is with the Aggregate Industries, the site will not be released until it meets the <br />approved reclamation plan. Please acknowledge. <br />5) Attached with the Technical revision is a map labeled as the "Hammer Pit ". Is the Bright Pit now known <br />as the Hammer pit? Please explain. <br />6) Please provide a detailed map showing the total lake and wetland areas that will remain in place as part <br />of the post mining land use? The operator stated, "The current revision request further reduces the <br />aerial extent of exposed groundwater with additional backfilling and grading to varied contours ". Does <br />that mean the current water augmentation or water substitute supply plan from the State Engineer will <br />be sufficient to meet their requirements?
