Mr. Clements <br />June 11, 2013 <br />Page 2 <br />If the Applicant desires to move forward with rehabilitation and development of the historic <br />Wanakah Mine and Bright Diamond Mine, please submit an application for a Limited Impact <br />110 type mining operation, or Regular 112 type mining operation, as appropriate for the surface <br />acreage and production of the proposed operation. Given the potential for exposure or <br />disturbance of toxic or acid - forming materials, the potential for generation of acid mine drainage, <br />and the need to protect the existing prevailing hydrological balance, the Division will require the <br />Applicant to demonstrate the proposed mining operation is not a Designated Mining Operation <br />(Rules 1. 1(l), 1. 1(2), and 1.1(14)). If it cannot be demonstrated that the mining activities will <br />not a have the potential for acid generation an appropriate 1 l Od or 112d permit with the required <br />Environmental Protection Plan (EPP) as required per CRS 34 -32- 103(3.5) and Rule 6.4.21 shall <br />be submitted.
