The application was received on May 21, 2013 and called complete for
review on May 31, 2013. The application request to add 774.8 acres to the permit area; however no disturbance is
proposed for the new area. The permit revision proposes to disturb an additional 65 acres within the currently
approved permit area. On November 16, 2012, Trapper provided the Division with updated threatened and
endangered species information in regards to Permit Renewal application No. 6 (RN6). Trapper identified Greater
Sage- Grouse has been deemed a candidate for threatened and endangered status and have added this species to
section 2.4.2; the Threatened and Endangered Species section, of the permit. The last section 7 consultation
conducted at the Trapper Mine was in April of 2013 during the RN6 application process.
The Division would like to confirm that a section 7 consultation is necessary for this permitting action, and if so
would formally request to initiate this process with your office.
Fish and Wildlife species at the site are discussed in section 2.4 of the permit and the Wildlife Mitigations Plan is
located in section 4.6. Enclosed with this letter are the revised pages Trapper submitted to the Division in regards to
threatened and endangered species during RN6. Also enclosed is updated water depletion information and the latest
biological opinion provided by the US Fish and Wildlife Service ( USFWS). RN6 has not been finalized at the
writing of this letter; however, it is my understanding from Nicole Caveny with your office that the final
documentation from the USFWS the Division needs to complete the permit renewal process should arrive in the near
future.
Should you have any questions, please feel free to call me at (303) 866 -3567 ext. 8120 or e -mail me at
Jared.Ebertgstate.co.us
Sincerely,
Jared Ebert
Environmental Protection Specialist,
DRMS
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
John W.
