Public Notice
The Division of Reclamation, Mining and Safety, in accordance with Title 34, Article 33, of the Colorado
Revised Statutes, hereby issues notice that on May 17, 2013, a minor revision application (MR -6) to the
New Horizon North Mine, Permit No. C- 2010 -089, operated by Western Fuels- Colorado, LLC, 12050 N.
Pecos St., Suite 100, Westminster, CO 80234 was considered complete for the purposes of filing. A
Compliance Order on Consent (COOC) has been issued to the operator by the Air Pollution Control
Division (APCD) of the Colorado Department of Public Health and Environment for Phase 2 work. The
COOC approves additional topsoil removal activities and the commencement of box cut excavation,
including drilling and blasting activities. All reviews and comment periods as provided in the Act and
Regulations promulgated thereunder initiate from this date of filing.
