PERMIT #: M- 1989 -023 <br />INSPECTOR'S INITIALS: BMK <br />INSPECTION DATE: June 6, 2013 <br />OBSERVATIONS <br />1) The Division conducted a surety related inspection of the site to verify current financial warranty is <br />adequate prior to approving the succession of operation application. <br />2) The operator submitted a succession of operation application choosing option "A ". The Division sent an <br />incompleteness letter on 5/7/13. <br />3) The Division has to conduct an inspection of the site within 30 days when option "A" is selected. For a <br />110 operation the affected area and permit area are the same. The permit area for the site as <br />amended in 2010 is 9.5 acres. <br />4) The Division utilized an Abney level; GPS and range finder were used to verify current disturbance and <br />height of the high wall. <br />5) The Division at present is holding a financial warranty in the amount of $43,000.00 <br />6) There was a front end loader parked along the south side of the active mining face. A small amount of <br />stockpiled processed material was also noted indicating recent fresh mining related activity. Along the <br />south west side of the permit area, a small amount of overburden/ topsoil stockpile was observed. <br />7) The active mining high wall was found to be stable and no problem noted. Height of high wall ranged <br />from 6 feet along the east side to 23 feet along the north side. <br />8) Permit sign and boundary markers were properly posted. <br />9) The Division will recalculate the financial warranty as an update but the current financial warranty in <br />place is more than adequate at this time. <br />Page 2 of 4 <br />
