Pineda <br />Director <br />Florence, CO 81226 <br />Re: Marr Mine (Permit No. C- 1980 -006) <br />Bond Release Application No. 5 (SL -5) — Final adequacy letter <br />Dear Mr. Patterson: <br />As you know, a bond release inspection was conducted by myself, Dan MacKinnon of OSM, and Gordon <br />Brocker, representing Energy Fuels, on December 17, 2012. The inspection covered the Marr Mine site <br />and the loadout facility, and one adequacy issue was identified. The two alluvial monitoring wells (AP -1 <br />and AP -2) at the loadout needed to be removed. A follow -up inspection by DRMS (May 23, 2013) <br />confirmed that these wells were removed. Furthermore, DRMS has received the well abandonment <br />reports for these two wells. <br />Subsequent to the bond release inspection, another issue arose. The loadout facility was broken into, and <br />vandals left four -wheel drive tracks on the area where the pond was reclaimed and where the pond was <br />accessed. The Division has determined that the amount of damage caused (I estimate that less than five <br />percent of the loadout area was impacted) does not warrant a delay in the bond release process. <br />All adequacy issues have been met by Energy Fuels, and I will be issuing my proposed decision <br />(approval) in the near future.
