ARH U100111,01pok!�MMOrowng ]KINSM <br />THIS MATTER came before the Mined Land Reclamation Board ( "Board") on <br />May 15, 2013 in Denver, Colorado to consider a financial warranty forfeiture and <br />revocation of permit number C-1981-033 issued to Bear Coal Company ('Operator"). <br />Assistant Attorney General Julie M. Murphy and Sandra Brown appeared on behalf <br />of the Division of Reclamation, Mining and Safety {"Division"). There were no <br />appearances on behalf of the Operator. <br />The Board, having considered the materials presented with this matter and <br />having been otherwise fully informed of the facts in this matter, hereby enters <br />the following: <br />1. The Division issued the Operator reclamation permit number C -1981- <br />033 for a 1,108.4-acre coal mining operation. The mine site, known as Bear Coal <br />Mine No. 3, is located in Section 8, SE 1/4, SE 1/4 of Township I South, Range 90 <br />West, 6th Principal Meridian, Gunnison County, Colorado. <br />2. The Division issued permit number C-1981-033 to the Operator in <br />1981. The Operator renewed permit every five years thereafter until its most <br />recent renewal that the Division issued in July 2007. <br />3. Mining ceased at the site in 1996. In 1997, portals at the site were <br />sealed. Partial reclamation was completed in 1998. <br />4. On April 4, 2011, the Operator filed Articles of Dissolution with the <br />Colorado Secretary of State. <br />5. On October 24, 2011, the Division sent the Operator correspondence <br />regarding the right of successive renewal for the permit because the permit would <br />expire on July 19, 2012, unless the Operator sought renewal. On December 29, <br />2011, the Division received a letter from the Operator stating that the Operator <br />"does not intend to renew the DRMS permit." <br />6. Permit number C-1981-033 expired on July 19, 2012. The Operator did <br />not apply to renew the permit even though reclamation of the mine was not complete. <br />
