<br />2.03.5 Compliance Information
<br />Colowyo, its subsidiaries, affiliates, or persons controlled by or under common control with Colowyo has
<br />not had a federal or state mining permit for surface coal mining operations suspended or revoked in the
<br />last five years; or forfeited a mining bond or similar security deposited in lieu of bond.
<br />Since no suspension, revocation, or forfeiture has occurred, Part 2.03.5(2) is not applicable to this
<br />application.
<br />A list of violation notices received during the last three years by Colowyo in connection with the surface
<br />coal mining operation is provided in Exhibit 2, Item 3 Volume 2A which is periodically updated by
<br />Colowyo. The list of violation notices received by those companies related through the "ownership and
<br />control" relationship is also provided in Exhibit 2, Item 3.
<br />2.03.6 Right of Entry and Operational Information
<br />The revised Colowyo permit boundary including the Collom permit expansion area includes all or
<br />portions of Township 3 North Range 94 West of the 6th P.M. Sections 1, 2, 3, 10, 11, 12, 13, 14, 15, 22,
<br />and 23 and Township 4 North, Range 94 West of the 61h P.M. Sections 12, 13, 23, 24, 25, 26, 27, 34, 35,
<br />and 36 and Township 3 North Range 93 West of the 6"' P.M. Sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 14, 15,
<br />16, 17, 18, 19, 20, 21, 22, 28, 29, and 30 and Township 4 North Range 93 West of the 61h P.M. Sections 7,
<br />13, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 26, 27, 28, 29, 30, 31, 32, 33, and 34. The document contained
<br />in Exhibit 1, Item 13, vests the complete permit boundary description. The documents contained in
<br />Exhibit 1 Volume 2A, vests the rights shown in and to the surface estate and to the coal estate within the
<br />Collom permit expansion area.
<br />BLM surface targeted for future potential disturbance within the permit boundary but outside any federal
<br />coal lease boundaries will not be disturbed until appropriate right of way agreements allowing planned
<br />disturbance are in place and in full effect.
<br />2.03.7 Relationship to Areas Designated Unsuitable For Mining
<br />The Collom permit expansion area is not within an area designated unsuitable for surface mining
<br />activities as defined in Rule 7 or 30 CFR 764 and 769 or under study for designation in an administrative
<br />proceeding under Rule 7 or 30 CFR 764 and 769.
<br />2.03.8 Permit Term Information
<br />The term of mining for Little Collom X and Collom Lite pits within the Collom permit expansion area is
<br />from 2012 through 2031 with reclamation work extending into 2033. Colowyo has submitted information
<br />within this application to cover the entire life -of -mine area, including the next five -year permit term. The
<br />anticipated timetable for each phase of mining and the anticipated aerial extent to be affected are shown
<br />in Map 23B.
<br />The initial approval of the Colowyo Permit No. C -81 -019 issued on November 4, 1982 applied to the
<br />entire initial permit area which also represented the life -of -mine area at that time. The acquisition of
<br />Federal Coal Leases C- 0123475, C- 0123476, and COC -68590 and State Lease 257 -13s has provided for
<br />substantial mineable coal reserves at Colowyo. The information submitted herein applies to the Colowyo
<br />entire revised permit area which also represents a revised life -of -mine area. The initial permit application
<br />has been revised where appropriate to incorporate the mining of these additional reserves.
