Pecos St., Suite 100 <br />D1fector <br />Westminster, CO 80234 <br />Re: New Horizon North Mine — Permit No. C- 2010 -089 <br />Minor Revision No. 5 (MR -05) —Water Well Completion <br />Preliminary Adequacy Review <br />Dear Mr. Anderson: <br />The Division received an application for MR -05 on April 8, 2013, and deemed it complete for <br />purposes of filing on April 22, 2013. This revision seeks to update the New Horizon North Mine <br />permit to include specific details regarding the domestic well that was permitted and constructed <br />within the mine's surface facilities area. Construction of the well was permitted under NOI No. <br />X- 2011 - 142 -14. <br />When we began to review the application for adequacy, we recognized that an outdated version <br />of the permit text for Section 2.05.3(3) had been used as the base document. Refreshed pages <br />were received on May 31, 2013, together with a request to extend the Decision Date from May 2 <br />to June 11, 2013. The date was extended by the Division, as requested, in a letter dated June 3, <br />2013. <br />The original MR -05 application included the following items: revised Section 2.05.3(3) Mine <br />Facilities Table of Contents (TOC) and Text); a new Appendix 2.053(3) -5 Water Well <br />Completion Diagrams and Report; and revised Maps 2.04.7 -1 Hydrologic Water Monitoring <br />Locations and 2.05.3(3) -1 Facilities. The May submittal provided a new revised Section <br />2.05.3(3) Mine Facilities. <br />The Division has reviewed the MR -05 application for adequacy. Our comments are itemized <br />below, for your consideration and response. We have also prepared a Reclamation Cost Estimate <br />for the addition of the well to the permit. The RCE is attached to this letter, for your reference. <br />The resulting increase to the mine's bond liability will be $3,301.31. <br />Adequacy Comments <br />The well completion diagrams and report that have been provided for insertion as a new <br />appendix to the permit are adequate with respect to the rules.
