overburden. Refuse Area 5A would receive the greatest impacts and should still be active at the
time of subsidence. A monitoring and maintenance commitment has been added to Section
III.A.7h addressing potential subsidence impacts. These refuse areas already receive frequent
inspection, maintenance, and reporting to address these types of issues.
DBMS: Response is sufficient.
5) DBMS: Please describe how BME plans on monitoring and addressing any potential issues
from subsidence that may occur to the Red Wash Reservoir 42.
BME: Damage from subsidence to Red Wash Reservoir 42 is not expected to be extensive. This
reservoir has remained essentially dry with minor amounts of water present only during spring
runoff and after exceptional runoff events. As mining gets deeper the resulting impact from
subsidence decreases. Provisions addressing impacts to stock ponds and reservoirs can be found
in Section III.A.Th. Any stock ponds or reservoirs damaged by subsidence will be repaired as
necessary.
DBMS: Response is sufficient.
6) DBMS: During an inspection conducted by the Division in April 2013, an apparent air
monitoring station was observed south of the Red Wash Reservoir 42. Please describe how
BME plans on monitoring and addressing any potential issues from subsidence that may occur
to the air monitoring station.
BME: The remnants of air monitoring station observed in April 2013 are from a station the
Deserado Mine was originally required to operate as part of our Air Quality Permits. This
requirement was removed from the permits about 20 -years ago. Any impact to the remnants by
subsidence, regardless of severity, would be inconsequential.
DBMS: Response is sufficient.
7) DBMS: Are there any additional structures such as wells, pipelines, culverts, fences and
gates not under the ownership of BME within the proposed expansion that would be affected by
subsidence? If so, please describe how BME plans on monitoring and addressing any potential
issues from subsidence that may occur to these structures.
BME: The only structures not previously listed and not under BME's ownership within the
