o Chemicals: The use of chemicals in waters that will or may be discharged is not allowed unless expressly authorized <br />by the Division. The Division has reviewed the MSDS sheets for 2 chemicals that were submitted with the <br />application. A summary of the review is shown in the following table. <br />Chemicals deemed acceptable for use in waters that will or may be discharged to waters of the State are <br />acceptable only when used in accordance with all state and federal regulations, and in strict accordance with the <br />manufacturer's size- specific instructions. <br />o Anddlegradation: 4n Antidegradation review does not apply to this permit as this is a temporary discharge, and <br />therefore exempt from an antidegradation review. If this is to become a more permanent discharge point, the <br />permittee will be required to amend the individual permit to include this outfall. For this reason, this certification <br />will expire in one year. <br />General Information: <br />• Permit Action Fees: The fee `or this Modification is $429 based on 55% of the annual fee of $780 [Category 7, Subcategory 5 <br />Coal Mining per CRS 25- 8 -SO2]. The invoice will be sent to the legal contact shortly. <br />• Changes to the Certification —Any changes that need to be made to the certification page — changes in outfalls, monitoring <br />requirements, etc., must be submitted using the "Permit and Certification Modification form" available on our website: <br />coloradowaterpermits.con, and signed by the legal contact. <br />• Discharge Monitoring Report (DMR) forms will be mailed out within the next month. Reports must be submitted quarterly <br />as long as the certification is in effect. The permittee shall provide the Division with any additional monitoring data on the <br />permitted discharge collected for entities other than the Division. This will be supplied to the Division within 48 hours of <br />the receipt of the data by the permittee. If forms have not been received, please contact the Division at 303 - 692 -3517. <br />• Sampling Requirements Sampling shall occur at a point after treatment, or after the implementation of any Best <br />Management Practices (BMPs). If BMPs or treatment are not implemented, sampling shall occur where the discharge <br />leaves control of the perm ttee, and prior to entering the receiving stream or prior to discharge to land. Samples must be <br />representative of what is entering the receiving stream. <br />• Stormwater Management Plan — See Part I.C. of the permit for storm water requirements <br />At the time of application. the permittee certified that they had developed and implemented a Stormwater Management <br />Plan (SWMP) for this facility. The permittee shall amend the SWMP whenever there is a change in design, construction, <br />operation, or maintenance which has a significant effect on the potential for the discharge of pollutants to the waters of the <br />State, or if the SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in stormwater <br />discharges associated with mining activity. A copy of the SWMP must be kept on site and provided to the Division upon <br />request. <br />• Best Management Practices - The permittee shall implement and maintain the Best Management Practices (BMP) for the <br />prevention of erosion and the control of solid and liquid pollutants due to the discharge. BMPs include various options, <br />such as: modification of the pipe discharge structure to disperse flows; containment of water by berms or other comparable <br />structures; the use of geocloth, filter fabric, or plastic sheeting for protection of containment structures; rip -rap; and /or any <br />other approved methods. <br />• Termination requirements - nor termination of permit coverage, the permittee must initiate this by sending the "CDPS <br />Permits and Authorization Termination Form." This form is also available on our web site and must be signed by the legal <br />contact. <br />• Analytical and Sampling Methods for Monitoring: <br />The permittee shall install, calibrate, use and maintain monitoring methods and equipment, including biological and indicated <br />pollutant monitoring methods. All sampling shall be performed by the permittee according to specified methods in 40 C.F.R. <br />Part 136; methods approved by EPA pursuant to 40 C.F.R. Part 136; or methods approved by the Division, in the absence of a <br />method specified in or approved pursuant to 40 C.F.R. Part 136. <br />The analytical method and PQL selected for a parameter shall be the one that can measure at or below the numeric <br />effluent limit.
