Box 483 <br />Paonia, CO 81428 <br />Re: Bowie No. 2 Mine (Permit No. C- 1996 -083) <br />Request to Vacate Notice of Violation No. CV- 2013 -004 <br />Dear Mr. Bear: <br />In your letter dated May 22, 2013, Bowie Resources, LLC (BRL) requested the vacation of Notice of <br />Violation (NOV) No. CV- 2013 -004 for the Bowie No. 2 Mine. After reviewing BRL's request for vacation <br />and the Division's observations that the placement of coal mine waste was not in accordance with the <br />Rules and approved plan, it appears that NOV CV- 2013 -004 was properly issued. Therefore, I am <br />upholding the NOV at this time. <br />The information you provided is helpful and will be used when the civil penalty is proposed. Upon <br />receipt of the notice of proposed civil penalty, BRL will have the opportunity to request an assessment <br />conference. The request for conference must be returned to the Division within ten days of BRL's <br />receipt of the notice of proposed penalty.
