TR -01 revises <br />Section 6.3.2 Exhibit C — Mining Plan to include a description of the Neilson Pit <br />operation as an intermittent status (IS). Per C.R.S § 34- 32.5- 103(11)b; Rule <br />1.13.5(1), the permit application must include a statement that if affected lands <br />are used for less than one hundred eight days (180) per year that the operator <br />must apply for an intermittent status. Under this cover and in accordance with <br />rules Colowyo is applying for an IS status for the Neilson Pit. <br />Within this application for IS, Colowyo is submitting pages 3 through 8, and a <br />revised table of contents (page i) for Permit No. M- 2007 -026. Specifically, Section <br />6.3.2, page 3 has been revised to include a statement for the IS. The additional <br />pages submitted are to capture correct pagination within the permit document in <br />relation to this additional text. <br />Furthermore, beginning in 2013, Colowyo will demonstrate through its annual <br />report that active mining occurs each year the operation remains in IS.
