Room_' 15 <br />Denver, Colorado. 80203 <br />Re: Oxbow Mining LLC, Permit No. C -1981 -022 - Request for MR -105 — Dewater utility <br />borehole 42 for mine recovery efforts. <br />Dear Mr. Bowles. <br />Recall that Oxbow Mining, LLC requested a Minor Revision No. 104 to Permit C- 1981 -022. The <br />purpose of that previous MR was to provide for five utility boreholes to access and monitor the <br />mine atmosphere during the mine recovery effort and one mine dewater borehole. The mine dewater <br />borehole was successfully drilled and the mine was found to contain approximately 90' of water at <br />this location. The purpose of this MR -105 is to enable Oxbow to drill a dewater borehole #2 at the <br />same pad location as the original dewater borehole #1. Having the flexibility to install a second <br />borehole will provide the flexibility to install a second pump in the event the first pump is slow to <br />overcoming the 2.500' of vertical head in dewatering the mine. <br />We have included revised Exhibit 2.04 -E3, Item 9- Methane Drainage Well Information and <br />Drawing 2.05 -M1, Sheet 6 of 6, "General Facilities, Gob Vent Boreholes." <br />Please contact me at (970) 929 -5806 should you have questions or require further information. <br />Sincerely, <br />James A.
