decreases. Provisions addressing impacts to stock ponds and reservoirs can be found in Section
III.A.7.h. Any stock ponds or reservoirs damaged by subsidence will be repaired as necessary.
6. The remnants of air monitoring station observed in April 2013 are from a station the Deserado
Mine was originally required to operate as part of our Air Quality Permits. This requirement was
removed from the permits about 20 -years ago. Any impact to the remnants by subsidence, regardless
of severity, would be inconsequential.
7. The only structures not previously listed and not under BME's ownership within the expansion
area are several culverts and barbed /woven wire fences and gates. The culverts happen to be outside of
the proposed mine /subsidence area but from experience we wouldn't expect any notable impact
regardless. Barbed/woven wire fences and gates are not adversely impacted by subsidence.
8. We hereby request that the entire Section II.A be retained in a confidential file excluded from
review by the public. This request is made to conform to 43 CFR 7.18. This request also includes
removing any such information from the Laserfiche system.
A cover page referring the reader to the "Confidential" file is enclosed. Survey reports for COC -74813
are included in this correspondence in a separate envelope marked "Confidential ". These reports and
other information within Section II.A contain classified information that is to remain confidential
pursuant to 43 CFR 7.18. Please ensure that any previously archeological reports are placed or
retained within the "Confidential" file.
9. Maps identifying these resources are included in reports added to Section II.A.
10. The monitoring plan agreed to by BME, BLM, and SHPO is attached for inclusion in Section
II.A that addresses monitoring of these sites. As noted in Item 8, this monitoring plan is to remain
"Confidential" to conform to 43 CFR 7.18. A reference to this monitoring plan was also added to
Section III.A.7.1.
11. Comment noted.
12. Thank you for catching this error. The cover page should refer to Exhibit I -5 for the proof of
publication. A revised cover page for Exhibit I -5 along with the Proof of Publication is enclosed.
If you have any further questions please contact me at 970 - 675 -4322.
Sincerely,
Scott Wanstedt
Environmental Engineer
swanstedt(&deserado.com
enc:
cc: Jeff Dubbert w/o Foster Kirby - OSMRE
Paul Daggett — BLM
