Mr. Andy Rodriguez <br />Poudre Pits Aggregate Mine SWSP <br />May 29, 2013 <br />Page 5 <br />The 13 shares will be diverted at the Tigges farm headgate and measured at the augmentation <br />station. All measurements must be made and recorded to the satisfaction of the water commissioner. <br />During months where the projected diversions will exceed the mining and operational depletions and the <br />monthly return flow attributed to these shares, the excess water will be diverted into an unlined pit where <br />it will recharge the ground water and create lagged accretions. It is projected that this will occur from <br />May through August with a net amount of 90.43 acre -feet being recharged. The recharge will be lagged <br />to the river using the same parameters as the Tigges depletions and will result in a lagged accretion of <br />42.74 acre -feet during this approval period. <br />The 13 Rural Ditch shares are insufficient to provide replacement during the months of January <br />through April, and again from October through December. To cover these months the Applicant has <br />obtained leases with the City of Aurora ( "Aurora "), Varra Companies ( "Varra "), and the Groundwater <br />Management Subdistrict ( "GMS ") of the Central Colorado Water Conservancy District. <br />The Applicant has a lease with Aurora to provide fully consumable water for their Brighton <br />Combined Gravel Pit SWSP (WDID 0202587) and Shores Gravel Pit SWSP (WDID 0502522). Aurora <br />approved releasing an additional 9.81 acre -feet in January and 7.79 acre -feet in February on this lease <br />on behalf of this SWSP. This water is released from the Metro Waste Water Treatment Plant (WDID <br />0200700) and is assessed a transit loss of 25.5% to account for 51 stream miles at 0.5% per mile loss. <br />The Applicant also entered into a lease with Varra Companies for the months of January through <br />March 2013. Releases will be made from water stored in Varra's 112 Reservoir (WDID 0504001), <br />Dakolios East Reservoir (WDID 0504003) or their Von Ohlen Reservoir (WDID 0504002). This water <br />was stored during free river from September 2009 through June 2010. According to information <br />submitted by Varra, at the beginning of January 2013, there was 1,446 acre -feet stored in these <br />reservoirs. Varra has included this lease on their Reservoir Operations Study. Water from these <br />reservoirs is also used in Varra's SWSPs with WDIDs 0502513 & 0302535. Varra will release this water <br />into a ditch that terminates into the St. Vrain River. All measurements must be made to the satisfaction <br />of the water commissioner. During the non - irrigation season the water will be available to make <br />replacements at the Cache la Poudre's confluence with the South Platte River. A transit loss of 0.5 % <br />per mile for 33 miles will be assessed for all released made by Varra. During the non - irrigation season <br />there is not a calling right on the Poudre river between the Poudre Pits and the confluence with the South <br />Platte River. <br />With the leases from Aurora and Varra, additional water is still needed during the months of <br />January through March. To make this plan whole during these months the Applicant is utilizing excess <br />credits from their Shores Gravel Pit SWSP (WDID 0502522). Submitted April 2013 accounting for the <br />Shores SWSP (attached) confirms these credits were realized. The Shores SWSP is approved pursuant <br />to § 37 -90- 137(11) and is owned and operated by the Applicant and therefore the utilization of Shores <br />credits will be allowed. The credits are assessed a transit loss of 16.5% to account for 33 stream miles <br />at 0.5% per mile loss. <br />To cover the month of April, the Applicant has obtained a lease with the Groundwater <br />Management Subdistrict ( "GMS ") of the Central Colorado Water Conservancy District for 19.2 acre -feet <br />of GMS water. This water will be released from Central's La Poudre Reservoir (WDID 0303377) located <br />within the boundaries of La Poudre Aggregate Mine M- 1983 -090. A copy of the signed lease was <br />provided to this office on May 23, 2013 and is attached. <br />To cover the months of October through December, the Applicant will need to obtain a sufficient <br />lease that can provide replacement water either to the site, or to the Poudre's confluence with the South <br />Platte River. This lease has not been obtained and thus this SWSP will expire on August 31, 2013 but <br />will be automatically extended to December 31, 2013 upon the submission of a sufficient lease to our <br />office. <br />
