May 21, 2013 <br />Mr. Eric Fenster, Esquire <br />Technical Review Comments: Application for Certificate of Designation, Proposed Henderson Inert Landfill, <br />Adams County, Colorado <br />Page 5 <br />monitoring system will be thirty (30) years unless the Division approves a request by the <br />Henderson Inert Landfill to decrease the period in accordance with Section 3.6.3 of the Solid Waste <br />Regulations. The Division requires the initially approved post - closure care period to be no less than <br />thirty (30) years for all aspects of post - closure care. Pursuant to the provisions in Section 3.6.3 of <br />the Solid Waste Regulations, the post - closure period can be increased or decreased by the Division <br />after consultation with the local governing authority. A request for such a modification to the <br />post - closure care period typically would be made during the post - closure care period, and would be <br />based on operating history, ground water monitoring data, and other pertinent site - specific <br />information. <br />7. For Section 11.1 (Closure Financial Assurance), Section 12 (Post- Closure Financial Assurance), <br />and Attachment 7 (Henderson Inert Landfill Closure and Post - Closure Cost Estimates) of the Plan <br />(Tarry 2012), please note the following: <br />• The Division requests that, with the final submittal, the Henderson Inert Landfill submit <br />closure and post - closure care costs separately, though in the mean time the Division can <br />review the costs already submitted and provide comments as necessary. <br />• Please contact Division Financial Analyst Enrique Martinez (303- 691 -4054, <br />Enrique. Martinezna,state.co.us) to coordinate review of the closure and post - closure care <br />costs and the establishment of financial assurance. <br />8. Section 13.8 (Fees) of the Revised Plan (Tarry 2013) states that the Henderson Inert Landfill will <br />pay the Solid Waste User Fee (see Section 1.7.4 of the Solid Waste Regulations) on a quarterly <br />basis based on the amount of fill, using accurate accounting records, accepted during the quarter. <br />The Solid Waste User Fee is due one month after the end of each quarter. A form for the use of the <br />Henderson Inert Landfill in preparing the quarterly fee can be found at the Division's web site here: <br />h=://www.colorado.gov/cs/Satellite/CDPHE-HMCBON/1251616360987 <br />Click on the Solid Waste User Fee tab, then click on the Non -NPL Sites form (i.e., the upper link) <br />to download the form and start using the Microsoft Excel spreadsheet. <br />Within thirty (30) calendar days of the receipt of this letter, please submit for Division review a <br />Revised EDOP that addresses the comments referenced above. <br />The Division is authorized to bill for its review of technical submittals at $125 per hour, pursuant to <br />Section 1.7 of the Solid Waste Regulations.
