May 21, 2013 <br />Mr. Eric Fenster, Esquire <br />Technical Review Comments: Application for Certificate of Designation, Proposed Henderson Inert Landfill, <br />Adams County, Colorado <br />Page 3 <br />solid wastes disposal site and facility is located at least ten but no more than thirty days <br />prior to the date of the hearing. In addition, the notice of such public hearing shall be <br />posted at a conspicuous point in at least one location at the offices of the governing body <br />having jurisdiction and in at least one location at the proposed site. Such notice shall be <br />posted for a period beginning at least thirty days before the public hearing and continuing <br />through the date of such hearing. <br />(b) At the public hearing held pursuant to the provisions of this subsection (3), the <br />governing body shall hear any written or oral testimony presented by governmental entities <br />and residents concerning such proposed site or facility. All such testimony shall be <br />considered by the governing body having jurisdiction in making a decision concerning such <br />application. For the purposes of this subsection (3), "residents " means all individuals who <br />reside within the geographic area controlled by the governing body having jurisdiction or <br />within three miles of the proposed site and facility or who own property which lies within <br />three miles of such proposed site and facility without regard to which county or municipality <br />such individuals reside within. <br />In addition, on March 8, 2013, the Division received from the Henderson Inert Landfill's authorized <br />representatives an approval to exceed 30 hours of billable time, if needed, during the review of the <br />Application. As of the date of this letter and including time for the completeness review, there are 49.5 <br />hours of billable time charged to this project. The Division estimates that if the Application is revised <br />suitably in response to the comments noted below, the revised document will be constructible and will be <br />approximately 90 percent complete pending public comment, and the Division will start the public <br />comment period noted above. Also on March 8, 2013, the Division received a Revised Plan (Tarry 2013), <br />prepared in response to the preliminary comments noted in the Division's completeness review letter dated <br />February 22, 2013. Finally, 120 85 LLC and the Division met on April 3, 2013, to discuss the permitting <br />process and to discuss initial comments noted in the Division's completeness review letter. <br />The Division has completed its initial technical review of the Application including the Revised Plan <br />(Tarry 2013), and requires the Henderson Inert Landfill to provide additional information and to modify the <br />Revised Plan (Tarry 2013). Prior to submittal of any such modification, the Division recommends that the <br />Henderson Inert Landfill respond to each comment in writing, and submit the required additional <br />information for review and approval. We are available to meet and discuss your responses prior to a formal <br />submittal and document modification. Typically, after the revised document has been submitted, the <br />Division will, as noted above, initiate a written public comment period of thirty (30) calendar days <br />following the issuance of a public notice. <br />Presented below are the Division's Technical Review Comments on the Revised Plan (Tarry 2013). <br />1. Section 3.3 (Property Ownership) of the Plan (Tarry 2012) states that (1) It is estimated that <br />approximately 100,000 cubic yards of material are necessary to fortify the slurry wall and avoid <br />further breach; and (2) These repairs are underway and are expected to continue throughout the <br />review phase of this Application. The Division understands that DRMS made the determination <br />that the slurry wall needed to be fortified and provided the estimate of volume of fill material <br />
