<br />In Notice of Violation No. CV- 2013 -004, the deadli ne for Step 1 abatement of the practice, condition
<br />or violation described was fixed at June 28, 2013, and Step 3 was fixed at June 30, 2013.
<br />It is hereby found that the operator has failed to abate such practice, condition or violation, or cannot
<br />complete abatement within the time al lowed, but that such failure is not due to lack of diligence on the
<br />part of the operator. The ti me for abatement is therefore extended to July 31, 2013 for Steps 1 and 3.
<br />The conditions, practices or violation as to which this extension applies areas follows:

<br />1. Place and compact all existing end- dumped material on Gob Pile #2 in accordance with the Rules
<br />and approved per m i t appl i cat on package no I ater than Jul y 31, 2013.
<br />3. Conduct quarterly i nspections of Gob Pi le #2 i n accordance with ad I of the requi rem ents of Rule
<br />4.10.2, beginning with the second quarter or 2013; submit the second quarter report to the
<br />Division no later than July 31, 2013.
