Exhibit Page 17
generally on the floor of the pit or in the outer perimeter, before using to backfill. Overburden and excess
materials will be used for backfill as the initial step in reclamation, to create stable slopes, cover shale
overburden, and provide smoother terrain suited for grazing. This will include filling ravines to smooth the south
slope of the mesa. Backfilling is expected to vary from 1 to 30 feet in depth, based on topography. See cross -
sections, Exhibit E -1. If backfilling is done in areas that are not actually mined, vegetation and sufficient soil to
replace soil on the backfilled area will be removed prior to backfilling.
Grading to control erosion, siltation and prevent damage (3.1.5(3))
Grading will be done so that erosion and sediment is controlled on affected lands and so that there is no
damage to areas outside those. All highwalls (mining faces) will be eliminated, and final slopes will be below the
angle of repose to prevent potential slides or other damage on affected lands or outside the permit boundary.
Temporary grading, including berms, rock check dams, swales, etc. may be incorporated during mining and
reclamation as necessary. As much as possible, there will be no discharge from disturbed areas, and if there is
discharge, will be through sediment basins or other permanent controls.
Performance as soon as feasible (3.1.5(4))
For most of the affected area, the time between initial disturbance and final reclamation will vary from five years
to one year. Because of requirements for work area (see Mining Plan), this area will not be fully reclaimed until
the end of the life of the mine. Roads and roadside areas outside the mining area will be at final grade and
surface within 2 -3 years of start -up but may not have release requested until later, because of maintenance.
Some mining areas will be used for access and have reclamation delayed until later. Backfilling and grading will
be done quickly but placement of soil may wait until use of the area for access, stockpiling, and storm water
control ceases; otherwise reclamation (backfill, grading, placement of soil) should be accomplished within one
year of completion of extraction, with seeding to follow as soon as possible based on recommendations (See
Exhibit J). Release will be requested when adequate vegetation is established.
Refuse and acid - forming or toxic producing materials (3.1.5(5))
No acid - forming or toxic producing materials are anticipated to be exposed, mined, or processed at this site.
Any excess materials after crushing and screening, including product not processed or sold at the time of
closure, will be incorporated into backfill, except for any stockpile of material left for landowner use after
reclamation and release. Fuels, lubricants, raw materials (AC oil, Portland cement, admixtures, etc.) and other
chemicals necessary for the operation and maintenance of plants, equipment and trucks will be located in the
work area with suitable spill /leak protection and reporting.
Holes, etc. (3.1.5(6))
There are no drill holes, auger holes, adits or shafts to reclaim.
Maximum slopes (3.1.5(7))
All areas, including basins, former headwalls, and berms, shall have slopes not exceeding 2H:1V, with a goal of
3H:1V. Slopes as proposed are compatible with surrounding conditions and land use.
Use of farm equipment (3.1.5(8))
Only the work area will be reclaimed (returned to cropland) and will allow use of farm equipment. The mining
area, as pasture/ grazing land, has no use of farm equipment anticipated, but slopes will be as compatible with
equipment use in the area, such as mowing, seeding, or weed control.
Notice of other backfill (3.1.5(9))
The Applicant will comply with this requirement to notify the Division if other backfill is used. The Applicant
expects some use of excavated clean overburden and soil from project sites supported by this operation to be
used for backfill or soil placement, and agrees to comply with requirements current at the time of use.
Prevention of unauthorized release of pollutants to surface water (3.1.5(10))
The Applicant will handle mined material to be disposed of on -site in a way to prevent unauthorized release of
pollutants to surface water, and comply with this requirement, as well as county regulations. See Exhibit G.
Prevention of unauthorized release of pollutants to groundwater (3.1.5(l 1))
The Applicant will handle material mined, handled, consumed, or disposed of on -site in a way to prevent
unauthorized release of pollutants to groundwater, and comply with this requirement. See Exhibit G.
