Dear Mr. Karo,
We have received your application for bond release at the Seneca II -W Mine. Our initial review
indicates that all preliminary items required by Rule 3.012(1) have not been submitted. Thus, your
application is incomplete for the purposes of filing as of May 23, 2013.
The Division has reviewed the proposed newspaper public notice submitted with the application. The
notice does not include some information that Rule 3.03.2 (1)(b) requires. Please revise the notice to
include the type and amount of bond currently filed for this site and the amount of bond sought to be
released. Also, please include a brief description of the type and appropriate dates of reclamation work
performed and a description of the results achieved as they relate to the approved reclamation plan.
Once these corrections have been made, the noticed must be published. Please submit the proof of
publication of the approved notice from the local news paper.
In accordance with Rule 3.012(1)(d), you have the opportunity to amend, review, or otherwise make
your application complete.
