Exhibit D - Mining Plan <br />9.) The proposed affected area will not be in the Surveyor Creek. Material will be mined from the rangeland to the North <br />of the creek bank to 60 feet south of the fence separating the Railroad right -of -way and proposed site. Stockpiled material <br />will be outside the creek banks so as to protect the natural flow of the Surveyor Creek. We will mine to the approximate <br />same elevation as the surveyor Creek, which is 4,339 ft. above sea level. <br />10.) As recommended we will stabilize the topsoil stockpile with one of the recommended grass species <br />11.)
