Our initial review indicates <br />that all preliminary items required by Rule 3.03.2(1) have not been submitted. Thus, your application is <br />incomplete for the purposes of filing as of May 23, 2013. <br />In accordance with Rule 3.03.2(1) and (2), prior to filing the bond release request the permittee must send <br />written notice of their intentions to seek release from bond to adjoining property owners, surface owners, <br />appropriate local government bodies, municipalities, regional planning commission, board of county <br />commissioners, county planning agencies, sewage and water treatment authorities, and water <br />conservancy and water conservation districts in the locality of the mine operation. Copies of these <br />notices must be submitted to the Division within (30) days of filing the request for release. Also, Trapper <br />must submit the proof of publication of the approved notice from the local news paper. <br />The Division noticed that Williams Fork Land Company was omitted from the list of adjoining surface <br />owners to be notified.
