Division Director
State Reclamation and Mining Safety
1313 Sherman Street
Room #215
Denver, CO 80203
May 17, 2013
Dear Sir,
c 4 l cv-, Coq (,ti,
A,_7s ->>a
RECEIVED
MAY 2 0 2013
Division of Reclamation,
Mining & Safety
Our address is 369 East 8th Street, Greeley, CO 80631. The legal description is Lot 4
of the SW /4 N /W4 subdivision of Union Colony. Section 4, Township 5N, R65W.
In 1994 we purchased 20 acres at the above address. At that time and until just
recently, there was a pond, complete with cat tails and families of geese and ducks. This
pond was labeled "pond wetland" by the county and the Army Corps of Engineers as
shown on the attached plat plan. This shows how the storm drainage comes from the
north of the property, thru the pond and on down the storm water drainage ditch. Each
year as the water table came up; the pond would fill up and then drain out in the fall and
winter.
Our problem: The owners of the land to east of us have opened a gravel mining
operation and it appears that they have filled in the natural drainage ditch which drained
the water from our area in cases of flooding and overflow. They are pumping the water
from the mine area. The pond is not our only concern however. We also have a
permitted well that we use to water our lawn, trees and immediate area, not an acre (not
quite an acre). We are concerned that if the mining company continues to drain the water
from our land, and the pond, (which is already dry) our well will also go dry.
The previous owners of the mining company were more neighborly. They made sure
our pond had water. When the pond filled to a certain level, the water ran out to a pipe
and on down the drainage ditch. NO PROBLEM!
We need your help to restore our pond, and the water well. Please help preserve our
wetland, wildlife habitat, trees and garden, etc. It was never a problem for the previous
mining operation to maintain our ground water level. We see no reason why it should be
a problem now. Please help us by doing whatever is necessary to restore our water.
Sincerely,
Larry and Lois Monroe
