RULE 2 PERMITS
The legal or equitable owners of record of the property to be mined or affected by surface operations and
facilities incidental thereto are:

The legal or equitable owner of record of the coal to be mined is the United States of America, the State
of Colorado and Guy and Holmes Shefstead, P.O. box 608, Craig, Colo. 81626
Colowyo is the holder of Federal Coal Lease No. D- 034365, C- 29225, C- 29226, and State of Colorado
Coal Lease 257 -135.
The surface and mineral ownership in the permit and adjacent areas is graphically shown on the Surface
Ownership Map (Map 1) and the Coal Ownership Map (Map 2) and the information found in Exhibit 1,
Documents and Leases.
Colowyo is the only holder of record of any leasehold interest in the property to be mined or to be
affected by surface operations and facilities incidental thereto. There are no other holders of record of
any leasehold interests for areas located within the property boundary.
Colowyo is both the applicant for the permit and the operator of the mine. The resident agent of Colowyo
who will accept service of process, including the telephone number, is as follows:

Colowyo Coal Company L.P. will remit all required AML fees.
Colowyo Coal Company L.P. is a limited partnership between two wholly owned subsidiaries of Western
Fuels — Colorado LLC. It's General Partner and Manager is Axial Basin Coal Company, which hold a
20% partnership interest in the Colowyo Mine. The remaining 80% partnership interest is held by Taylor
Creek Holding Company. Western Fuels — Colorado is owned by two entities, Western. Fuels
Association, Inc. (1 %) and Tri-State Generation and Transmission Association (99 %). The ownership
and control information is provided in Exhibit 2, Volume 2A.
There is no pending purchaser of record of any surface or mineral estate under a real estate contract for
areas located within the permit boundary.
The information required under Rule 2.03.4 regarding surface coal mining permit information through
"ownership and control" relationship is provided in Exhibit 2 of this Permit.
Information regarding the internal Permit area and contiguous surface and subsurface ownership may be
found in Exhibit 1, Item 11.
Colowyo owns various interests in land contiguous to the Colowyo Permit Area. These lands are
operated as agricultural properties and contain no areas of coal where mining has occurred 1977.
