The Division of Reclamation, Mining and Safety (Division) received Oxbow Mining LLC's
(OMLLC) application for Permit Renewal No.6 at the Elk Creek Mine on March 18, 2013. RN-
6 was deemed complete on March 27, 2013. The Division has reviewed the permit and has the
following questions and comments:
Rule 2.03
1. Please revise the Identification of Interests Permit pages 2.03 -6 to 2.03 -9 to reflect the
latest changes in staffing.
2. Please verify that all Legal Descriptions in Section 2.03.6 Right of Entry and Operation
Information are accurate and include Federal Coal Lease COC- 70615. For example, the
last sentence on page 2.03 -15 states that the lease is still expected.
3. Please update Section 2.03.10 and verify that Other Licenses and Permits reflect the
current information. This section was last updated for RN -5 in 2008.
Rule 2.05.3
4. The language at the end of page 2.05 -6 is not consistent with the top of pages 2.05 -7 or
2.05 -7a. Please clarify the language.
5. Three different descriptions of the Elk Creek Coal Handling, Support and Ancillary
Facilities are located on pages 2.05 -7, 2.05 -7a and 2.05 -13. A fourth section labeled Elk
Creek Mine Facilities starts on page 2.05 -21 and has many bulleted items that are
duplicates of the bulleted items on page 2.05 -13. Please update, combine and number
these sections /pages for consistency.
