BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />Violation No. PV- 2013 -004 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF A POSSIBLE VIOLATION BY CATALIX INTERNATIONAL, <br />LLC, CEASE AND DESIST ORDER, CORRECTIVE ACTIONS, AND CIVIL <br />PENALTIES FOR PROSPCTING WIHTOUT A NOTICE OF INTENT TO <br />CONDUCT PROSPECTING OPERATIONS, File No. P- 2013 -008 <br />THIS MATTER came before the Mined Land Reclamation Board ( "Board ") on <br />April 17, 2013 in Denver, Colorado for a hearing to consider the possible violation <br />by Catalix International, LLC ( "Catalix "), cease and desist order, corrective actions <br />and civil penalties for prospecting without a Notice of Intent to Conduct Prospecting <br />Operations, file number P- 2013 -008. Ben Langenfeld appeared on behalf of Catalix. <br />Tyler O'Donnell appeared on behalf of the Division of Reclamation, Mining and <br />Safety ( "Division "). <br />The Board, having considered the parties' presentations and having been <br />otherwise fully informed of the facts in the matter, hereby enters the following: <br />FINDINGS OF FACT <br />1. On February 15, 2013, the Division received a 110d application from <br />Catalix for Precious Mine ("Application "). The Precious Mine is located in Section 19, <br />Township 22 South, Range 57 West, 6th P.M. The Application proposed extraction of <br />precious metals from shale using acid solutions. <br />2. On March 4, 2013, the Precious Mine applicant notified the Division <br />six prospecting holes were previously drilled on 80 acres that includes the 8.5 -acre <br />proposed permit area. <br />3. On March 15, 2013, the Division conducted a pre - operation inspection <br />of the proposed Precious Mine site. Ben Langenfeld attended the inspection. The <br />inspection found six, 6 -inch diameter holes. Three of the six holes are located inside <br />the proposed permit area; three of the six holes are located outside the proposed <br />permit area. Catalix's representative reported that the holes range between 30 and <br />50 feet in depth. <br />4. On March 18, 2013, the Division mailed a Notice of Reason to Believe <br />letter to Catalix along with the March 15, 2013 inspection report. <br />
