SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No.: CV- 2013 -004 <br />NATURE OF VIOLATION: <br />Failure to place refuse material on Gob Pile #2 in a controlled manner to ensure stability of the fill, as required by <br />Rule 4.09.1(1)(c). <br />Failure to transport and place, on Gob Pile #2, refuse material in horizontal lifts in a controlled manner, and <br />concurrently compact as necessary to ensure mass stability and prevent mass movement, as required by Rule <br />4.09.1(7) <br />Failure to consider the steepness of slopes, seepage, and other visible factors which could indicate potential failure, <br />as part of the quarterly inspection as required by Rule 4.10.2(c). <br />Failure to maintain a minimum static safety factor of 1.5, on Gob Pile #2, as required by Rule 4.10.4(2). <br />Failure to divert surface runoff from the fill surface to stabilized channels off the fill which will safely pass the <br />runoff from a 100 -year, 24 -hour precipitation event on Gob Pile #2 and Gob Pile #4, as required by Rules <br />4.10.1(1)(a) and 4.09.2(7). <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT SECTION(S): CRS 34- 33- 120(2)(v) and 34- 33- 121(d) <br />REGULATIONSECTION(S): Rule 4.09.1(1)(c), Rule 4.09.1(7), Rule 4.10.2(c), Rule 4.10.4(2), Rule 4.10.1(1)(a), <br />Rule 4.09.2(7). <br />PERMIT SECTION(S): Volume IX, Pages 12 -13 <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />Gob Pile #2 and Gob Pile #4 <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />Abatement Step # Description <br />1 Place and compact all existing end - dumped material on Gob Pile #2 in accordance with the <br />Rules and approved permit application package. <br />2 Remove cover fill material from ditches D -F5 and D -176 and repair or reconstruct all lateral <br />ditches on Gob Piles 2 and 4 to ensure positive drainage as designed in the approved permit <br />application package. <br />3 Conduct quarterly inspections of Gob Pile #2 in accordance with all of the requirements of <br />Rule 4.10.2, beginning with the second quarter of 2013. <br />TIME FOR ABATEMENT (NOT MORE THAN 90 DAYS): <br />ON OR BEFORE last abatement due date <br />Abatement Step # Due Date <br />1 June 28, 2013 <br />2 June 28, 2013 <br />3 June 30, 2013 <br />
