Toelle Loretta Pineda <br />Holcim US Director <br />3500 State Hwy 120 <br />Florence CO 81226 <br />Re: Request for Temporary Cessation Status for Slab Canyon Quarry (M1977 -347), Boettcher <br />Sandstone Quarry (M1977 -345) and Boettcher Limestone Quarry (M1977 -348) <br />Dear Mr. Toelle: <br />On May 7, 2013 DRMS received a request from Holcim for the three above referenced sites to be placed <br />into temporary cessation status. This request was accompanied by the appropriate $144 fee for each site <br />($432 total). <br />According to the material submitted in the request(s) for temporary cessation, mining ended at these sites <br />in 2002, there is no intent to resume mining activity, and these sites are only awaiting completion of final <br />reclamation at this time. Section 1.13.3(1) of the Construction Materials Rule, Indications Against <br />Temporary Cessation, states that: "Extraction of construction materials has been completed and only final <br />reclamation and related activities occurring at the site are part of the "life of the mine ". Therefore, upon <br />review of these submittals and the rule, it has been determined that these three sites are not eligible for <br />temporary cessation status. The Division will deny the request for temporary cessation status and return <br />your $432 in revision fees separately as soon as the refund request is processed. <br />Furthermore; DRMS would like to again notify Holcim of Section 34- 32.5- 112(6) of the Colorado Land <br />Reclamation Act for the Extraction of Construction Materials which states: "Reclamation shall be <br />completed within five years after the date the operator advises the board that each phase of construction <br />material extraction has been completed...... Such five year period may be extended by the board upon a <br />finding that additional time is necessary for the completion of the terms of the reclamation plan ". On at <br />least the three above referenced sites, more than 10 years has elapsed since active mining has been <br />conducted. Therefore DRMS is allowing one year from the mailing date of this letter to complete <br />reclamation of the above referenced Holcim sites.
