Exhibit A <br />b) The representations, statements and positions contained in the record that were made <br />by or attributed to the applicant and its representatives, including all such statements <br />contained in materials submitted to the Board by the applicant and County staff. <br />3. Approval of this Use by Special Review shall be and is subject to the following stipulations <br />and/or conditions precedent, which the applicant has accepted and which the applicant is <br />also deemed to accept by preparing a mylar for signature by the Chairman of the Board of <br />County Commissioners within sixty (60) days of this date and by continuing with the <br />development of the property: <br />a) The applicant's compliance with the stipulations of the Arapahoe County Planning <br />Commission as set forth in its resolution. <br />b) The applicant's compliance with all conditions of approval recommended by the <br />staff case managers in the written staff reports presented to the Board, and any <br />conditions stated by staff on the record. <br />C) The applicant's compliance with all additional conditions of approval stated by the <br />Board, including: <br />1. The Applicant must make all minor modifications to the Use by Special <br />Review exhibit as requested by the Public Works & Development Department. <br />2. The Applicant must address the Division of Engineering's comments and <br />concerns given in their reports. <br />3. The Applicant will obtain an approved GESC permit. <br />4. The Applicant will obtain necessary Oversize /Overweight Vehicle <br />Permits. <br />5. The Applicant and/or contractors are responsible for dust control and <br />mitigation on unpaved roads and the well pad. <br />6. The applicant will obtain necessary Access Permit(s) and as a condition of <br />the Access Permit(s) the Applicant agrees to maintain any damage to all public <br />roadways used for truck and drilling traffic during the drilling and completion of <br />the oil & gas well. <br />7. The Applicant will do baseline testing of all water wells within 1/2 mile of <br />the oil and gas well and give the option of baseline testing to the owners of any <br />wells located between 1/2 mile and 1 mile of the oil and gas well, at the applicant's <br />expense. <br />8. The Applicant will have all lights during the drilling phase to be in a <br />downward position. <br />9. The Applicant will have a closed -loop drilling system. <br />10. The Applicant will obtain all necessary permits, including Building <br />Permits. <br />11. The Applicant will be responsible for noxious weed control from the <br />drilling phase to closure of the well. <br />12. The Applicant will recontour the well pad roughly to original contours, <br />reclaim and reseed the pad area at the final reclamation stage (well closure). <br />
