<br />I, K. Crimmins, do solemnly swear that I am Legal
<br />Notice Representative of theCraig Daily Press, that the
<br />same is a daily newspaper printed, in whole or in part,
<br />and published in the County of Moffat, State of
<br />Colorado, and has a general circulation therein; that
<br />said newspaper has been published continuously and
<br />uninterruptedly in said County of Moffat for a
<br />period of more than fifty -two weeks prior to the first
<br />publication of the annexed legal notice or
<br />advertisement; that said newspaper has been admitted
<br />to the United States mails as second -class matter
<br />under the provisions of the Act of March 3, 1879, or
<br />any amendments thereof, and that said newspaper is a

<br />Public Notice
<br />Pursuant to the Rules and Regulation of the
<br />Colorado Mined Land Reclamation Board
<br />published August 1980, and pursuant to the
<br />Colorado Surface Coal Mining Reclamation
<br />Act 34 -33 -101, et seq., notice is hereby
<br />given of the filing of an application for Phase
<br />I Bond Release of a portion of the Colowyo
<br />Mine site The application pertains to the
<br />existing Cobwyo Coal Mine, Permit No.
<br />C -81 -019 by Colowyo Coal Company LP.,
<br />5731 State Highway No. 13, Meeker, Colo-
<br />rado 81641, filed with the Colorado Division
<br />of Reclamation, Mining and Safety (CDRMS),
<br />Colorado Department of Natural Resources,
<br />1313 Sherman Street, Room 215, Denver,
<br />Colorado 80203 and approved by the Divi-
<br />sion on September 15, 2009 (latest Permit
<br />Renewal) The Colowyo Mine is located ap-
<br />proximately 28 miles south of Craig, Colo-
<br />rado.
<br />The bond release areas, which include areas
<br />reclaimed In 2012, total 137 4 acres, and are
<br />shown in detail in Exhibit 1 Listed below is a
<br />general legal description of these areas:
<br />Township 3 North,
<br />Ra nge 93 West of the 6th P.M.
<br />Section 4 -N 112;
<br />Section 10 -SW 1/4;
<br />Section 15 - NW 1/4
<br />Section 17 - N Yz;
<br />Colowyo currently has two surety bonds to-
<br />taling $80,517,829, which include the above
<br />listed areas Exhibit 1 presents all of the re-
<br />claimed areas by year. The status ofthe rec-
<br />lamation is cons' stem with the requirements
<br />of the approved reclamation plan and is fur-
<br />ther described in the 2012 Annual Reclama-
<br />tion Report
<br />A copy of the bond release application is on
<br />file at the Moffat Court Clerk and Recorder's
<br />Office located in the Moffat County Court-
<br />house, 221 West Victory Way, Craig, Colo-
<br />rado 81625 Written comments, objections,
<br />and requests for a public hearing or informal
<br />conference concerning this bond release ap-
<br />plication should be addressed to the
<br />CDRMS, Colorado Department of Natural
<br />Resources, 1313 Sherman Street, Room 215,
<br />Deriver, Colorado 80203.
<br />Comments must be filed within thirty (30)
<br />days from the last date of this publication, or
<br />within thirty (30) days of the completed in-
<br />spection by the CDRMS.
