Damaged concrete structures such as sewer pipe may be buried on site at <br />pre- approved (by DRMS technical revision process) locations. <br />22. The road easement referenced is the same road easement currently under lease with the <br />City of Canon City and is the main entrance to the mine from the southeast portion of the <br />affected land area. <br />23. Tezak Heavy Equipment Company, Inc., has signed a structures agreement with Black <br />Hills Energy, aka West Plains Energy, addressing all easements and utility structures that <br />could be affected by mining operations. No other structures agreement should be <br />necessary. <br />24. A geotechnical Stability Exhibit has been completed which addresses increased highwall <br />total height at maximum mine build -out as well as potentials for rock character variations <br />which may affect overall slope stability. <br />25. The geotechnical stability exhibit submitted with this mailing includes state -of- the -art <br />mine bench stability analysis utilizing Galena 6.0 software based on rock input <br />parameters of granite gneiss samples from the highwall zone analyzed by Colorado <br />School of Mines Earth Mechanics Institute. The Galena program, used in the original <br />1997 study, has been revised and upgraded over the past sixteen years and is the current <br />highwall stability software utilized by the US Office of Surface Mining. <br />26. The road referenced near the end of the Geotechnical Stability Exhibit is the main access <br />road across City of Canon City property entering the affected land along the southeastern <br />boundary line just west of the water treatment plant entrance. The road is currently under <br />long -term lease with the City and will stay an integral part of the mine operation as well <br />as access to the City of Canon City water treatment facility. Tezak Heavy Equipment Co. <br />has committed to final reclamation of the road right -of -way at the termination of the road <br />agreement.
