M- 1977 -193 AM -05 Response to April 5, <br />2013 Preliminary Adequacy Review letter. <br />Dear Mr. Cazier, <br />Responses to the Division's comments will be presented in order made in your April 5ch letter: <br />1. Applicant name on page 1 has been corrected to read " Tezak Heavy Equipment Co., Inc." <br />Please find a corrected page 1 in this mailing. <br />2. The main entrance location labels on the Exhibits B, C, and F and on page 2, Item 10 of <br />the application form have been revised and included in this mailing. <br />The revised permit boundaries as shown on all Exhibits included in this mailing reflect <br />the changes proposed in the acreage reduction request submitted to the Division in <br />February 2013. The operator understands that these changes cannot be considered for <br />inclusion in the permit amendment until the acreage reduction process is completed. The <br />Division approved the reduction request on April 9, 2013, and a 30 -day appeal period is <br />in effect. The operator requested a 30 -day extension of decision date by the Division on <br />April 10, 2013, which should put us past the appeal waiting period for acreage reduction. <br />Please notify the operator if there are other factors related to the acreage reduction <br />process that may delay the consideration of this permit amendment beyond May 15, 2013. <br />4. Mine entrance coordinates have been checked and revised as requested. <br />5. Exhibits B and C have been revised to show corrected mine entrance coordinates. <br />6. Topographic detail has been included on Exhibit C Pre - mining and Mine Plan map to all <br />areas not yet disturbed using USGS topographic sourced data and all areas already <br />disturbed (within current permit boundaries) using the operator's latest survey data. <br />These two surveys merge along the west boundary of the current mining permit area and <br />may reflect slight distortion of closely spaced contour lines merging along the boundary <br />between the two data sets. As mining progresses to the west onto BLM lands, the mine <br />operator's survey data will be continued to monitor and represent topographic change as <br />accurately as possible. <br />7. The easement marked "West Plains" is now a Black Hills Energy asset. The easement <br />contains power lines and poles but no roads. Tezak Heavy Equipment Company, Inc., <br />
