Response to DRMS Adequacy Review (1) — Cotter JD -9 Mine Reclamation Plan Amendment <br />Cotter will notify the Division of any spill of a toxic or hazardous substance, <br />including spills of petroleum products, that occur within the permit area and <br />which would be required to be reported to any Division of the Colorado <br />Department of Public Health and the Environment, the National Response <br />Center, the Colorado Emergency Planning Commission, any local Emergency <br />Planning Commission, local Emergency Planning Committee, or the State Oil <br />Inspector, consistent with the requirements of Rule 3.1.13. The haulage <br />contractor will be responsible for any en -route spills occurring off -site. <br />Exhibit E <br />12. On page E -4 under item g., it states that the transformer stations and power lines are the <br />property and responsibility of the San Miguel Power Association. Though the statement <br />clarifies who owns and who is responsible for the equipment it is still the responsibility of <br />the operator to assure all mining related equipment and infrastructure required to <br />support a mining operation be removed upon reclamation. Please commit to having the <br />transformer station and power lines removed upon reclamation. <br />Upon site reclamation, San Miguel Power will be informed that Cotter no longer <br />has a use for the transformer station and power lines. It is at the discretion of <br />San Miguel Power to remove or retain the transformer station and power lines <br />for use supplying power to nearby properties or for future use at this location. <br />13. On page E -4 item h., it is stated that Maps F -IA and B show the final configuration and <br />grading for the site. The referenced figures were not submitted with the application. <br />Please provide 2 signed copies of the referenced figures. Also, this section states that <br />cross sections are shown on Map C3. This is not a true statement as Map C3 has no cross <br />sections included. Please provide to copies of a figure with the cross sections to support <br />the proposed reclamation of the waste rock pile. <br />Figure F2 (Attachment 4) shows the final configuration and grading for the <br />site. Figures C5 and C6 show the cross section of the waste rock pile area. <br />Figures C5 and C6 are included as Attachment 5. <br />4 <br />
