Are there any renewable resource lands as defined by Rule <br />1.04(110) that are within the proposed permit expansion area that would be impacted by <br />subsidence? <br />4. It appears that sections of Refuse Pile's 2/3/4, 5A and possible future refuse pile <br />expansion areas will be undermined, possibly affecting stability and proper drainage of <br />the refuse piles. Please describe how BME plans on monitoring and addressing any <br />potential issues from subsidence that may occur to the refuse piles. <br />5. During an inspection conducted by the Division in April 2013, an apparent air <br />monitoring station was observed south of the Red Wash Reservoir 92. Are there any additional structures such as wells, pipelines, culverts, fences and gates <br />not under the ownership of BME within the proposed expansion that would be affected <br />by subsidence? If so, please describe how BME plans on monitoring and addressing any <br />potential issues from subsidence that may occur to these structures. <br />Rule2.04.4 — Cultural and Historic Resource Information <br />8. In Bureau of Land Management's Environmental Assessment for the Blue Mountain <br />Energy Coal Lease Application COC- 74813, they address cultural resources and list <br />thirteen historic properties that are potentially eligible for the National Register of <br />Historic Places. Of those thirteen historic properties, nine are currently not identified or <br />listed within BW's Section II.A — Archaeology Report (5RB6754, 5RB7286, <br />5RB7287, 5RB7289, 5RB7291, 5RB7296, 5RB7305, 5RB7307, and 5MF7622). Please <br />update Section II.A — Archaeology Report to identify and include the nine historic <br />properties not currently listed. <br />9. Please update Map 3 — Archeological Resources to include the locations of the nine <br />historic places not currently identified and the new proposed permit boundary. <br />10. From the letter dated on April 30, 2013, addressed to Mr. James Roberts of the Bureau <br />of Land Management from Edward Nichols of the Colorado State Historic Preservation <br />Office, it appears monitoring will be occurring for seven sites (5RB 1020, 5RB6754, <br />5RB7286, 5RB7287, 5RB7289, 5RB7291 and 5RB7305) that will be undermined or <br />affected by subsidence.
