Page 2 of 3 <br />Exploration Plan from the BLM including a Decision Memo of the Federal Coal <br />Exploration Plan from the USFS, Please submit the approved Federal Coal <br />Exploration Plan and the Decision Memo of the Federal Coal Exploration Plan from <br />the USFS for review. <br />2. Rule 2.02.2(2)(h) —The submitted ROD for the FEIS associated with the COC -1362 and <br />COC -67232 modifications states that, "Compliance with terms and conditions of the <br />Biological Opinion are addressed in lease stipulations for threatened and endangered <br />species... Appendix A of this BLM ROD." The referenced Appendix was not included in <br />the ALC submittal. Please submit a copy of FEIS ROD Appendix A for review. <br />The Division has received and reviewed the copy of the FEIS ROD Appendix A. <br />If it is the intention of ALC to utilize the results of the Federal Coal Exploration <br />Plan EA for compliance of Rule 2.02.2(2)(h), Please submit the results of the EA to <br />the Division for review. If ALC wishes to provide information satisfying Rule <br />2.02.2(2)(h) other than the EA, Please submit a statement with appropriate <br />references from the relevant State and Federal agencies which determines that the <br />exploration and reclamation will not jeopardize the continued existence of an <br />endangered or threatened species or result in the destruction or adverse <br />modification of critical habitat of those species. <br />Rule 2.02.2(2)(g) — The NOI lists Attachment No. 3 USFS Special Use Road Permit, <br />This attachment was not included in the NOI submittal. Please submit the approved <br />USFS Special Use Road Permit for review. <br />ALC submitted Attachment No. 3 — The USFS Special Use Road Permit. <br />Additional completeness comments: <br />4. Based on a review of the light -use roads proposed under NOI X- 2013 - 228 -01, the <br />locations of the roads appear to cross identified intermittent streams. Per Rule(s) <br />4.21.4(3)(b), Please provide information discussing the process in which ALC <br />proposes to control and minimize water pollution for the exploration operations and <br />any and all designs or models which support ALC's plan. <br />Determination of Amount of Performance Bond [Rule 3.05.2(1)] <br />The Division has prepared a preliminary estimate of the amount of performance bond sufficient <br />to assure the satisfactory reclamation of the proposed coal exploration disturbance if, in the event <br />of bond forfeiture, the work had to be performed by the Division through independent <br />contractors. The amount of performance bond calculated was $224,304.22. <br />Although the Division has found the above referenced NOI application incomplete, upon <br />acceptance of NOI X- 2013 - 228 -01 coal exploration cannot be initiated prior to receiving the <br />bond in the amount referenced above. <br />
