As we noted during our <br />conversation, AI has not conducted the Division of Water Resources (DWR) 90 -day leak <br />test, which will be required for DWR approval of the slurry wall prior to DRMS release <br />of AI from reclamation responsibility for the site. Since the slurry wall has not yet been <br />tested and approved, the integrity of the breach in the slurry wall will be assessed at the <br />time of the leak test. If the slurry wall does not meet the performance standards <br />necessary to obtain DWR approval, appropriate corrective measures will be taken at that <br />time. As DRMS currently holds a $670,602.00 financial warranty for installation of a <br />slurry wall that meets DWR requirements, the proposed technical revision should not <br />result in any additional bonding for reclamation. <br />Upon DRMS approval of the currently proposed request, AI will submit its request for <br />withdrawal of the previous revision approved by DRMS on January 16, 2013. <br />Thank you for your consideration in this matter.
