RULE 2 - PERMITS <br />2.06 Special Categories of Mining <br />2.06.1 Scope <br />Tills section establishes 111111111111111 regtl1rC1llCnt Im perinits tor the follo \\111 g applicable special <br />catcoor1Cs of tindergrolllld coal milling and reclamation operations. \\hlch are in addition to all <br />applicable permit application requirements and procedures of Rule 2: <br />• Prime larnllands <br />• 1\'lulul�� of alluvial valley floors <br />• Coal processing plants or support facilities not located within the permit area <br />2.06.6 Prime Farmlands <br />Prime farmlands do not exist within the PSCM permit area: therefore no additional provision is <br />required for this category (see Section 2.04.12). NRCS correspondence supporting this finding may <br />be found in Exhibit 2.04.12 -E1, NRCS Prime Farmland Correspondence. <br />2.06.7 Variances for Delay in Contemporaneous Reclamation Requirements in <br />Combined Surface and Underground Mining Operations <br />No variance for delay in contemporaneous reclamation rcgUlrC1l1C1ltS 111 combined S1.11 -face and <br />under1-11-01.1nd rninin(I operations is heeded for the follo\\illg reasons: <br />• The Seneca 11 Mille ceased operation in 1999 and has been reclaimed. <br />• The o \'al pit being excavated is for access to the `Vadge Searn to Construct Mine portals and <br />other facilities to Support all Underground mine and is not considered Slli'faCe Milling. <br />• Concurrent with the review of the PSCM PAP, PSCM \\-ill file an incidental boundary <br />change with CDRMS to move the Seneca II permit boundary east to match the PSCM <br />permit boundary. The reclamation bond for PSCM \will include any remaining facilities <br />from the Seneca 11 Mine. <br />2.06.8 Surface Coal Mining and Reclamation Operations on Areas, or Adjacent <br />to Areas, Including Alluvial Valley Floors <br />An alluvial valley floor (AVF) is present at the confluence of Grassy Creek and Little Grassy Creek. <br />On January 28, 2009, Tom Kaldenbach (CDRMS) indicated to Vernon R. Pfannenstiel, (Peabody <br />Energy) that existing data from the Seneca II permit satisfies baseline information requirements for <br />this AVF. He further stated that, based on the overlap of the Sage Creek permit area with the <br />Seneca II permit area, the alluvial valley floor qualifies for the pre - mining exemption of 424.3(4). <br />The CDRMS requested that PSCM collect hydrogeologic, topographic, soils, and vegetation <br />information at the confluence of Scotchman's Gulch with Grassy Creek to allow the CDRMS to <br />make a final determination regarding the potential for subirrigation and the existence of an alluvial <br />valley floor. The requested information is contained in Exhibit 2.06.8 -E1. <br />2.06.10 Coal Processing Plants and Support Facilities Not Located Within the <br />Permit Area <br />PSCM w-111 not operate any support facilities not located within the permit area.
