RULE 2 - PERMITS
maintenance facilities, roads and parking areas, electric power substation, drainage and sediment
control structures, material storage yards, and other ancillary facilities needed to support the mining
and related operations. Additional surface and mineral rights were purchased from Grassy Creek,
LLC in 2009. Part of the surface property included the facilities that were permitted and used at the
Seneca II mining operation. These facilities are shown on Map 2.05.3 -M1B, Mine Facilities Map
(North End). These facilities will be used for the life of PSCM.
The temporary topsoil and overburden stockpiles and any other inactive areas will be stabilized
through interim reclamation measures, including appropriate drainage controls and reseeding with a
temporary vegetative cover to minimize soil loss and erosion. Any coal refuse material
(development waste and any non - specification coal) and incombustible waste rock generated at the
PSCM will be transported to the Foidel Creek Mine's approved coal refuse disposal area (CRDA)
for permanent placement. The coal refuse and waste rock material from PSCM has been considered
in the design of the Foidel Creek Mine CRDA and is addressed in technical revision TR09 -67 to
permit #C -82 -056 for that mine. A variance for delayed reclamation operations in combined
surface and underground mining operations, relative to the mine portal face -up area and associated
temporary out -of -pit stockpiles is requested as part of this permit application. Given that the initial
five -year permit term only anticipates exploratory and mine development activities to establish
mining conditions, the associated reclamation plans reflect sealing of all mine openings, backfilling
of the portal face -up area, demolition and removal of all surface facilities, regrading to the approved
postmine topography, drainage reestablishment, soil material replacement, and reseeding of all
mining - related disturbance areas. If mining and market conditions are favorable and support
expansion to full -scale mining operations, the facilities in place at that time will be utilized to
support ongoing operations and facilities reclamation will be deferred to the end of the mine life.
The need for and timing of any additional future surface disturbances associated with vent shafts
and other facilities, as well as any plans for full -scale development and mining, will be dependent
on whether or not initial development indicates favorable mining conditions and on favorable
market conditions at the time that final mine feasibility is evaluated.
Any future coal exploration drilling to further define and characterize the coal reserve and strata
above and below the coal seam will be planned and permitted in accordance with applicable
provisions of Sections 2.02 and 4.21.
Coal may be transported from Twentymile, stockpiled, then screened /sized, and sold for public coal
sales. Coal would be stockpiled on the upper pad and access would be via the upper road as shown
on Map. 2.05.3 - MIA &B. Sales would be limited to daylight hours one day per week through
winter (March 31S). Approval would also be contingent upon compliance with the Air Quality
Permit.
PSCM Permit App. 2.05 -6 Revision 10 /10 /11
