As per Rule 4.06.3(2)(a)(i), protection measures of topsoil <br />piles shall be accomplished by an effective cover of non - noxious, quick growing annual and perennials plants. <br />With cheatgrass being listed as a noxious weed under state and local weed management associations and Rule <br />4.06.3(2)(a)(i), cheatgrass is not considered an acceptable form of vegetative cover for topsoil piles by the <br />Division. The Division feels that topsoil piles with an abundant amount of cheatgrass should be addressed by <br />Blue Mountain Energy as a maintenance issue. <br />The Division has multiple helpful documents related to cheatgrass that were written by Professor K. George Beck <br />of Colorado State University.
