April 22, 2013 <br />RE: M -2007 -014 Byzantine Quarry <br />Subject: Surety Reduction Request <br />Dear Mr. Cazier, <br />Byzantine Quarry LLC <br />1087 East Holiday Drive <br />Pueblo West, CO 81007 <br />Mr. Tim Cazier <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman St. Room 215 <br />Denver, CO 80203 <br />g ) <br />Please let this letter serve as a formal request to reduce the Surety Bond amount from the current <br />amount of $216,876.00 to a revised amount of $113,900.00. This request is substantiated by the fact <br />that the original re- vegetation seed application rate was over calculated in some instances by a factor of <br />10, as shown in "Attachment C". By using the correct application rates, it results in a substantially lower <br />cost to re- vegetate the site upon completion than was previously calculated. <br />I have also attached "Task 003" as calculated by DRMS staff to substantiate this request, as well as to <br />show the proper seed mix that is required to achieve the desired results. <br />Please do not hesitate to contact me if I can provide any further information. <br />Sincerely, <br />Daniel Tezak <br />
