all of the signatures could be collected during the meeting and your Plan of Operations <br />signed and a copy given to you at that time. <br />Until your Plan of Operations is signed by both you, as the Operator /Owner, and me, as the <br />South Park District Ranger, your mining operation on the Wild Blue Indian Unpatented <br />Mining Claim is not authorized, and the Cease and Desist will remain in place. <br />I cannot be too clear that your operating on the Wihl Blue Indian Unpatented Mining Claim <br />before your bond was paid and your Plan of Operations was authorized is not acceptable. You <br />were given ample opportunity to pay the bond and have the Plan of Operations authorized in <br />time to mine during the 2012 season. I understand you experienced a lot of frustration in <br />working with the Forest Service in order to mine on your claim; however, I am deeply <br />disappointed that at the eleventh hour you chose to mine without authorization. As such, I am <br />requesting that you meet with me, Kristen Sexton, as soon possible to discuss your Plan of <br />Operations and our expectations of you as you operate on National Forest System Lands. Please <br />call me no later than May 10, 2013 in order to arrange a meeting. <br />Pursuant to 36 CFR 251.87(d), you have the right to request a discretionary review of my <br />response to your appeal to the Regional Forester. A petition or request for a discretionary review <br />does not, in and of itself, give rise to a decision to exercise discretionary review (36 CFR <br />251.100). The Regional Forester has 15 days from the date when he receives the letter to decide <br />whether to exercise his discretion to review this dismissal. If you choose to petition or request a <br />discretionary review, please send it to: <br />Lastly, the address you provided of P.O. Box 341, Lake George, CO 80827 was used in sending <br />you the letter of noncompliance on February 8, 2013, yet the Lake George Post Office sent it <br />back to our office with a note, "Box Closed, Unable to Forward." However, I see that you used <br />that address as your business address. Please let us know if this address is in fact accurate.
