Water rights to be used for augmentation: Return flows from use of or direct <br />discharge of nontributary groundwater decreed herein. <br />14 Statement of plan for augmentation pursuant to 37-90-137(11 )(a)(;), C.R.S.. <br />Applicant is the owner and operator of a commercial sand operation located on lire <br />Subject Property. At full capacity the sand operation will cover an area of approximately <br />43 acres and expuse groundwater to the atmosphere which will cause depletions to Sand <br />Creek. The sand pit will be developed incrementally an f augmentation requirements will <br />vary dope.rarn f ::urf :cw area of the pit duri ^r; rb elnpment <br />Pursuant to 37- 92- 305(12)(a), C.R.S., portions of depletions caused to the stream <br />system from evaporation and the operation of the sand pit will be replz' ed by claiming <br />credit for the natural depletion to the stream caused by pre - existing natural vegetative <br />cover which is permanently replaced by the sand pit operation. For operation and <br />accounting of this plan for augmentation, Applicant has calculated a weighted average for <br />the density types of vegetation on the Suh;ect Property which will be removed by <br />construction of the pit. Applicant has calculated that gross evaporation is equal to 3.67 <br />acre -feet per surface acre of water to be exposed by the construction of the pit. Applicant <br />will be required to replace a net evaporation, based on an average credit for remove: of <br />vegetation, of 1.39 acre -feet per surface acre, resulting in a replacement requirement of <br />2.28 per surface acre. <br />As the size cf the pit expands and the exposed surface area increases, Applicant will <br />replace depletions to the stream system in a timely manner and in an amount based on the <br />net evaporation per acre described above. Replacement requirements will be calculated <br />at the end of each month, based the amount of surface acres exposed, amount of product <br />rrined, and water used for duet suppression, pursuant to the accounting form as shown on <br />Exhibit S attached hereto, Said replacement requirement will be returned each month by <br />return flaws from the use of or direct diechargc le the pit of the nontributary groundwater <br />rights decreed herein. For purposes of this decree, water used for washing of rock product <br />is estimated to return 96% of that water to the stream system, and water used for dust <br />suppression will be 100% consumed. <br />Applicant realizes that there is only sufficient nontributary groundwater underlying the <br />Subject Property as quantified in paragraph 5 above, to provide replacements tor <br />depletions associated with a maximum of 16.5 of the proposed approximately 43 surface <br />acres. Therefore, if the amounts of nontributary groundwater decreed herein are in an <br />insufficient quantity to replace depletons for the total 43 surface acres proposed under this <br />tOI I ICEIWP'.'
